Power of Attorney

A power of attorney allows a person to appoint another individual (an attorney-in-fact or representative) to perform specific legal acts on their behalf, either in Poland or abroad. The person granting the power of attorney is referred to as the principal, while the person receiving the authority is referred to as the attorney-in-fact.

The required form of a power of attorney depends on the legal act for which it is granted.

For example, a power of attorney authorizing the sale of real estate or the establishment of a limited property right over real estate must be executed in the form of a notarial deed.

In other cases, a power of attorney with a notarized signature may be sufficient.

A power of attorney may be prepared in Polish and, if required, an additional bilingual version may also be prepared in a foreign language.

A notary may certify the signature on a power of attorney drafted in a foreign language.

If the document is intended for use abroad, it may be necessary to obtain a certified translation of the power of attorney or the notarial certification clause, as well as an Apostille or legalization, depending on the requirements of the country where the document will be used.

Please note that a notary does not prepare certified translations and does not arrange for the issuance of an Apostille.
